Prison Rape Elimination Act (PREA)

The Prison Rape Elimination Act (PREA) of 2003 is a federal law established to address sexual abuse of detainees in the custody of U.S. correctional agencies.  PREA applies to all correctional facilities, public and private, including prisons, jails, juvenile facilities, community confinement facilities, and Immigration and Customs detention (ICE) facilities.

It is the policy of Shelby County Division of Corrections (SCDC) to provide a safe, humane, and secure environment, free from threat of sexual abuse for all inmates.  SCDC has established clear procedures for preventing, detecting, reporting, and eliminating sexual abuse.

Shelby County Division of Corrections Policy #333: Compliance with The Federal Prison Rape Elimination Act (PREA)

The purpose of this policy is to provide required Prison Rape Elimination Act (PREA) definitions, to establish the Shelby County Division of Corrections (SCDC) ZERO TOLERANCE position against prison sexual misconduct, and to provide guidance in prevention and tracking techniques for sexual misconduct directed toward inmate victims by employees and other persons.

PREA Incidents involve the following conduct: 

  • Inmate and Inmate Sexual Abuse
  • Staff and Inmate Sexual Abuse
  • Inmate and Inmate Sexual Harassment
  • Staff and Inmate Sexual Harassment
